Terms of Service

1. General information

These Terms of Service govern purchases made in the BY INCH online store, operated from Deotymy 7/9, 01-407 Warszawa, Poland, email: official.byinch@gmail.com, phone: +48 577 582 808 ("we", "us", "the Seller").

By placing an order you confirm that you have read and accept these Terms. Nothing in these Terms limits the rights you have as a consumer under mandatory law, in particular the Polish Civil Code and the Polish Act of 30 May 2014 on Consumer Rights.

2. Definitions

  • Customer — a person placing an order in the store.
  • Consumer — a natural person purchasing for purposes unrelated to their business or profession.
  • Sole trader with consumer rights — a natural person running a business who buys goods not of a professional nature for them (as shown by their registered business activities in CEIDG). Such customers enjoy the consumer protections described in sections 7 and 8.

3. Technical requirements

To use the store you need a device with internet access, an up-to-date web browser with cookies and JavaScript enabled, and an active email address.

4. Products and prices

  • Product descriptions and photos present the goods as accurately as possible. Small differences in color may result from screen settings and do not constitute a defect.
  • Prices are shown in US dollars (USD) or converted to your local currency. The final price, including any applicable taxes, is shown at checkout before you place your order. Shipping costs are shown separately before you place your order.
  • When we announce a price reduction, we also show the lowest price of the product in the 30 days before the reduction.

5. Placing an order

  1. Add products to your cart, enter your delivery details, choose a shipping and payment method, and click the button confirming the order with an obligation to pay.
  2. After placing an order, you will receive an email confirming its receipt. The sales contract is concluded when you receive this confirmation.
  3. We may cancel an order if payment is not received within 7 days, or in case of an obvious pricing error; in that case any payment received will be refunded in full.

6. Payment and delivery

Available payment methods are shown at checkout and are processed by trusted payment providers. We ship once payment is confirmed. Delivery methods, times and costs are described in our Shipping Policy.

7. Returns and right of withdrawal

You may return any item within 30 days of receiving it, without giving a reason. This includes and goes beyond the statutory 14-day right of withdrawal for consumers. Return shipping is free. The full procedure, refund rules and a model withdrawal form are set out in our Refund Policy.

8. Complaints (non-conformity of goods)

  • We are liable to consumers for any lack of conformity of the goods with the contract that exists at delivery and becomes apparent within 2 years of delivery.
  • To file a complaint, email official.byinch@gmail.com with your order number, a description of the problem and, if possible, photos.
  • We will respond within 14 days of receiving your complaint. If we do not respond within that time, the complaint is deemed accepted.
  • You may request repair or replacement. Where this is impossible, would require excessive cost, or the non-conformity is significant, you may request a price reduction or withdraw from the contract, in accordance with the law.
  • We cover the costs of repair, replacement and of returning goods under a justified complaint.

9. Out-of-court dispute resolution

We are committed to resolving any complaints directly with our customers, wherever you are in the world. If we cannot reach an agreement, you may contact the consumer protection authority or an out-of-court dispute resolution body in your country of residence. For cross-border disputes within the EU, free help is available from the European Consumer Centres Network (ECC-Net) and the European Commission's consumer redress portal. Consumers in Poland can also turn to the municipal or district consumer ombudsman (rzecznik konsumentów) or the Provincial Inspectorate of Trade Inspection (uokik.gov.pl).

10. Personal data

We process personal data in accordance with the GDPR. Details are set out in our Privacy Policy.

11. Intellectual property

All content in the store, including photos, texts, graphics and the BY INCH name and logo, belongs to us or our licensors and may not be copied or used without our consent.

12. Business customers

For customers buying for business purposes who are not covered by consumer protections, our liability under the statutory warranty for defects (rękojmia) is excluded to the extent permitted by law, and our liability is limited to the value of the order.

13. Final provisions

  • These Terms are governed by Polish law. For consumers, this does not deprive them of protection under the mandatory provisions of the law of their country of habitual residence.
  • We may amend these Terms for important reasons (e.g. changes in law or payment and delivery methods). Orders placed before an amendment are governed by the Terms in force when the order was placed.
